Declaration of Rights for Cetaceans: Whales and Dolphins

Based on the principle of the equal treatment of all persons;

Recognizing that scientific research gives us deeper insights into the complexities of cetacean minds,
societies and cultures;

Noting that the progressive development of international law manifests an entitlement to life by
cetaceans;

We affirm that all cetaceans as persons have the right to life, liberty and wellbeing.

We conclude that:

1. Every individual cetacean has the right to life.

2. No cetacean should be held in captivity or servitude; be subject to cruel treatment; or be
removed from their natural environment.

3. All cetaceans have the right to freedom of movement and residence within their natural
environment.

4. No cetacean is the property of any State, corporation, human group or individual.

5. Cetaceans have the right to the protection of their natural environment.

6. Cetaceans have the right not to be subject to the disruption of their cultures.

7. The rights, freedoms and norms set forth in this Declaration should be protected under
international and domestic law.

8. Cetaceans are entitled to an international order in which these rights, freedoms and norms can be
fully realized.

9. No State, corporation, human group or individual should engage in any activity that undermines
these rights, freedoms and norms.

10. Nothing in this Declaration shall prevent a State from enacting stricter provisions for the
protection of cetacean rights.

The Hired Gun Mechanism “We present and experimentally test a mechanism that provides a simple, natural, low cost, and realistic solution to the problem of compliance with socially determined efficient actions, such as contributing to a public good. We note that small self-governing organizations often place enforcement in the hands of an appointed leader–the department chair, the building superintendent, the team captain. This hired gun, we show, need only punish the least compliant group member, and then only punish this person enough so that the person would have rather been the second least compliant. Gun For Hire: Does Delegated Enforcement Crowd out Peer Punishment in Giving to Public Goods? “This paper compares two methods to encourage socially optimal provision of a public good. We compare the efficacy of vigilante justice, as represented by peer-to-peer punishment, to delegated policing, as represented by the “hired gun” mechanism, to deter free riding and improve group welfare. The “hired gun” mechanism (Andreoni and Gee, 2011) is an example of a low cost device that promotes complete compliances and minimal enforcement as the unique Nash equilibrium. We find that subjects are willing to pay to hire a delegated policing mechanism over 70% of the time, and that this mechanism increases welfare between 15% to 40%. I would welcome the government to seek advice and recommendation from others, both from within Hungary and from the Council of Europe and the United Nations. While any country was free to draft its own constitution, it had to be in line with international rules and norms. When such laws are adopted, it is the responsibility of the government to ensure that they comply with all relevant international agreements, including the protection of the freedom of media and expression.

They clearly need to be able to enter into contracts just like individuals. But they should not be treated as if they experience such essentially human emotions as embarrassment and a desire for self-expression. Thus they should not have the same rights to privacy and political freedom as a citizen, but should have only as much of a right to confidentiality and political participation as is helpful for the efficient functioning of business (including letting firms contribute to the public debate on the regulation of business). Companies—or rather their bosses and owners—should welcome such constraints: any further “rights” would, sooner or later, be matched by onerous responsibilities.
